Terms and Conditions

The 2nd Screen: Transforming Video Consumption Research Report (TSSTVC) is published by The Intersection and the 2nd Screen Society (S3). For the purposes of these Terms and Conditions, The 2nd Screen: Transforming Video Consumption Research Report and such other analyses, supplements and other information are referred to as the ‘TSSTVC Material’.

For the purposes of these Terms and Conditions ‘Subscriber’ means the individual or organization that has purchased a licensed document from S3 and the term ‘User’ means any individual user who accesses any TSSTVC Material.

TSSTVC Material is only available to the users designated by a Subscriber (‘Authorized Users’). The licensed document is known as the ‘Subscriber Edition’. In some cases a person will be a Subscriber, User and an Authorized User.

The restrictions that apply to the use of the Subscriber Edition are set out in Section C below. Many of these restrictions are lifted if portions of the TSSTVC Material is intentionally made available for free (i.e. published) on the S3 public website or other public websites. Those excerpts are then known as the ‘Free Excerpts’. The restrictions which apply to the use of the Free Excerpts are set out in Section B below. Some information in the Subscriber Edition may be excluded from the Free Excerpts. The period between release of the Subscriber Edition and publication of the Free Excerpts may vary.

A. General terms and conditions of use for all Users (Subscriber Edition and Free Excerpts)

1. Use of the Free Excerpts (TSSTVC Material available free on the S3 public website) constitutes an agreement between the S3 and the User as well as the User’s acceptance of the terms and conditions set out in this document.

2. Use of the Subscriber Edition TSSTVC Material constitutes an agreement between the S3 and the Subscriber as well as the Subscriber’s and each User’s acceptance of the terms and conditions set out in this document.

3. The Terms and Conditions listed here are the only Terms and Conditions of use that relate to the TSSTVC Material. Therefore, the S3’s general terms and conditions for other S3 publications or website materials do not apply.

4. The Subscriber is responsible for any breach of copyright committed by the User accessing the TSSTVC Material.

5. Portions of the TSSTVC Material may contain material copyrighted by a third party. If the User wishes to reproduce any such material, it must obtain the necessary permission from the copyright owner.

6. Copying, reproduction, modification, translation, alteration, amendment or disassembly work of TSSTVC Material is not permitted without the prior written consent of The Intersection and S3, except as set out below (see articles 9 & 14), and subject to articles 7 & 8. 7. Notwithstanding any use permitted elsewhere in these Terms and Conditions, without prior written permission from the S3, Subscribers/Users:

i. cannot sell, barter or otherwise profit financially from the distribution of, or provision of access to, copies of the TSSTVC Material, or part thereof where such part represents more than 1% of any single edition of TSSTVC Material;

ii. cannot store any TSSTVC Material in a shared electronic archive or database; and

iii. cannot use TSSTVC Material to compile historical (i.e., involving data from more than one TSSTVC Material publication) compilations or analyses other than for internal use.

8. If the User/the Subscriber has the right to reproduce certain portions of the TSSTVC Material in accordance with these Terms and Conditions of use, the User/Subscriber must ensure that the relevant material is correctly attributed to The Intersection and S3, mentions the title and date of the publication and includes a notation that the TSSTVC Material is copyrighted by the The Intersection/S3 (i.e., © The Intersection/2nd Screen Society, The 2nd Screen: Transforming Video Consumption Research Report [date of publication]). 9. All electronic uses are monitored via digital rights management software. Each Authorized User designated is permitted to access the report from two (2) devices by default (intended for PC and tablet access). While the digital rights management software is intended to enforce these terms and conditions, we reserve the right to restrict or revoke access for violations of these terms and conditions.

B. Additional terms and conditions of use for the Free Excerpts (for TSSTVC Material available free on the S3 public website)

10. Exceptions to the prohibition on copying/reproduction in article 6: Subject to articles 5, 7 and 8, above, Users can reproduce the following from the Free Excerpts TSSTVC Material without the prior written permission of the S3:

i. any and all tables, graphs and figures provided:

ii. that such tables are reproduced in their entirety without alteration; and
iii. that no more than 3 tables are published at one time in any publication or website;

iv. up to 15% of the text of a report (not including data, graphs and figures etc); and

v. (once excerpts of the Subscriber Edition become the Free Excerpts) material reproduced in accordance with article 14.

11. A User may make the link to the S3 public website on the User’s intranet or website.

C. Additional terms and conditions of use for the Subscriber Edition (i.e., any TSSTVC Material that is not available on the S3 public website)

12. Single-user and multi-user licenses are available for the Subscriber Edition TSSTVC Material.

13. Authorized Users (users designated by a Subscriber,or The Intersection) of the Subscriber Edition TSSTVC Material are never permitted, under any circumstances, to distribute copies of, or password(s) for, the Subscriber Edition TSSTVC Material outside their organization, including to clients, consultants or other third parties.

14. Once excerpts of the Subscriber Edition are posted on the S3 TSSTVC public website, they become the Free Excerpts and the Terms and Conditions of use for the Free Excerpts apply.

15. Single-user license:

A single-user license may be held by an individual or an organization. It permits the following use of the TSSTVC Material, without the S3’s prior written consent:

a) Paper copy: A single-user subscription allows the Authorized User to:

i. print one copy of the PDF version of the TSSTVC Material for his/her personal use;

ii. store the original paper issue of the TSSTVC Material and use it for consultation purposes (i.e. in his/her organization’s library).

b) Electronic copy: A single-user subscription allows the Authorized User to:

i. The Authorized User may only access the TSSTVC Material via the Adobe PDF Reader or , if available, via the DRM protected URL shared by S3 or The Intersection by using the userid and password provided to the Subscriber by the S3 or The Intersection.

ii. The PDF version cannot be published on the intranet or circulated or redistributed electronically inside or outside the Authorized User’s Organization.

16. Multi-user license:

An organization with a multi-user license may designate a certain number of individuals within its organization as Authorized Users (in accordance with the license obtained from the S3). For example, if a Subscriber purchases a multi-user license for 2-5 Users, the Subscriber can designate up to 5 individuals within the Subscriber’s organization as Authorized Users. It permits the following use of the TSSTVC Material, without the S3’s prior written permission:

a) Paper copy: A multi-user subscription allows the Authorized User to:

print one copy of the PDF version of the TSSTVC Material for his/her personal use;
i. if the license arises from a subscription purchased for more than 20 Users, the Subscriber may make as many copies as desired for internal use only within the Subscriber’s organization.

b) Electronic copy: A multi-user license allows the Authorized User to

i. receive from the S3, userids and passwords for use by Authorized Users only for access to the TSSTVC Material via the Adobe PDF Reader or , if available, via the DRM protected URL shared by S3 or The Intersection;

ii. if the license arises from a subscription purchased for more than 20 Users, the Subscriber may make available the current PDF version only on the Subscriber’s intranet and/or make the link to the DRM protected URL available to employees on the Subscriber’s intranet with a shared userid and password.

Notwithstanding the above, the Subscriber/User is not permitted to make the TSSTVC Material available to clients, consultants or to any other third parties, not even via the Subscriber’s intranet.
